이용약관

제1조 (목적)

이 약관은 Kommode(이하 "회사")이 제공하는 모바일 애플리케이션 GGWP(이하 "서비스")의 이용 조건과 절차, 회사와 이용자의 권리·의무를 정하는 것을 목적으로 합니다.

제2조 (용어)

• 판 — 이용자들이 목표와 기간, 벌칙을 정해 진행하는 대결 단위입니다.
• 인증 — 이용자가 그날의 목표 수행을 사진 또는 짧은 영상과 글로 기록하는 행위입니다.
• 벌칙 — 판에서 진 이용자가 이행하기로 스스로 정한 약속입니다.
• 참가 코드 — 판에 들어오기 위해 필요한 문자열입니다.

제3조 (서비스의 성격)

제4조 (계정)

1. 이용자는 Apple 또는 Google 계정으로 로그인하여 계정을 만듭니다. 회사는 별도의 비밀번호를 만들거나 보관하지 않습니다.
2. 이용자는 이름과 태그를 정하며, 이는 함께 판에 참여한 다른 이용자에게 표시됩니다. 로그인에 사용한 이메일 주소는 다른 이용자에게 공개되지 않습니다.
3. Apple 로그인에서 「나의 이메일 가리기」를 선택한 경우 회사는 실제 이메일 주소를 알 수 없으며, 애플이 만든 전달용 주소만 받습니다.
4. 만 14세 미만은 서비스를 이용할 수 없습니다.
5. 계정은 본인만 사용할 수 있으며 타인에게 양도하거나 빌려줄 수 없습니다.

제5조 (이용자가 올리는 콘텐츠)

1. 인증 사진·영상과 글의 저작권은 이를 올린 이용자에게 있습니다.
2. 이용자는 회사에 대해, 서비스를 운영하고 같은 판의 참여자에게 보여주기 위해 필요한 범위에서 해당 콘텐츠를 저장·복제·표시할 수 있는 권한을 부여합니다.
3. 인증 사진과 영상은 같은 판에 참여한 이용자에게 공개됩니다. 그 밖의 이용자에게는 공개되지 않습니다.
4. 올린 인증은 판의 판정 근거가 되므로 이용자가 임의로 수정할 수 없습니다. 삭제 요청은 관계 법령과 개인정보 처리방침에 따라 처리하며, 다른 참여자의 기록 보전 등 정당한 보존 사유가 있는 경우 필요한 범위에서 해당 기록을 분리 보관하거나 비식별·익명화할 수 있습니다.
5. 판이 끝나면 이용자는 결과 카드를 만들어 서비스 밖에 공유할 수 있습니다. 결과 카드에는 목표, 기간, 점수, 참여자의 이름과 벌칙 내용이 담기며 인증 사진과 영상은 담기지 않습니다. 공유할지 여부와 어디에 공유할지는 이용자가 정합니다.

제6조 (금지 행위)

이용자는 다음 행위를 해서는 안 됩니다.

• 법령을 위반하거나 타인의 권리를 침해하는 행위
• 도박, 사행 행위 또는 금전 편취를 목적으로 하는 판의 개설·참여
• 타인을 괴롭히거나 모욕하는 목표·벌칙·태그의 설정
• 성적이거나 폭력적인 내용, 혐오 표현이 담긴 사진·글의 게시
• 타인의 동의 없이 그 사람이 식별되는 사진을 올리는 행위
• 미성년자에게 유해하거나 부적절한 내용의 게시
• 자해·자살, 위험한 신체 활동, 과도한 음주·약물 사용, 섭식 제한 등 이용자 또는 제3자의 생명·신체·건강에 중대한 위험을 초래할 수 있는 목표·벌칙을 설정하거나 이를 조장하는 행위
• 서비스의 정상적인 운영을 방해하거나 부정한 방법으로 판정을 조작하는 행위

제7조 (신고와 조치)

1. 이용자는 부적절한 콘텐츠나 이용자를 info@kommode.ai로 신고할 수 있습니다.
2. 회사는 신고 내용을 확인한 후 관계 법령, 위반의 성격과 긴급성 등을 고려하여 합리적인 기간 내에 콘텐츠 삭제, 이용 제한, 계정 정지 등 필요한 조치를 취할 수 있습니다.
3. 이용자는 특정 이용자를 차단하여 함께 판에 참여하지 않을 수 있습니다.
4. 제6조를 중대하게 위반하거나 반복하여 위반한 경우, 또는 이용자나 제3자의 안전 보호나 서비스의 정상 운영을 위해 긴급한 조치가 필요한 경우 회사는 사전 통지 없이 콘텐츠를 삭제하거나 이용을 제한하고 계정을 일시 또는 영구 정지할 수 있습니다. 관계 법령상 통지가 필요한 경우에는 그에 따릅니다.

제8조 (서비스의 변경과 중단)

회사는 서비스의 내용을 변경하거나 중단할 수 있습니다. 이용자에게 불리한 중대한 변경은 시행일로부터 30일 전에 서비스 내 공지 또는 이메일로 알립니다.

제9조 (계약 해지)

1. 이용자는 설정 화면에서 언제든지 계정을 삭제할 수 있습니다.
2. 계정을 삭제하면 프로필과 전적이 사라지며 복구할 수 없습니다.
3. 이미 진행되었거나 종료된 판의 인증 기록은 다른 참여자의 기록 보전과 분쟁 대응을 위해 개인정보 처리방침에서 정한 기간 동안 보관될 수 있습니다. 보관 목적이 달성되면 삭제하거나 개인을 식별할 수 없도록 처리합니다.

제10조 (이용자 사이의 분쟁)

1. 진 이용자가 벌칙을 이행하지 않거나, 이행했는지를 두고 다투는 경우
2. 벌칙으로 금전이나 물품을 주고받기로 한 약속이 지켜지지 않은 경우
3. 인증 사진이 조작되었거나 사실과 다르다는 주장이 있는 경우
4. 이용자가 올린 사진이나 글로 인해 명예훼손, 초상권 침해 등의 문제가 생긴 경우
5. 목표나 벌칙의 내용 자체가 부당하거나 위법하다는 다툼이 있는 경우

이용자 사이의 분쟁은 당사자들이 해결해야 하며, 필요한 경우 수사기관이나 법원 등 적법한 절차를 통해야 합니다. 회사는 법령에 따른 요청이 있는 경우 그에 협조합니다.

이용자가 이 약관이나 법령을 위반하여 제3자에게 손해를 입히고 그로 인해 회사가 청구를 받거나 손해를 입은 경우, 해당 이용자는 회사를 면책시키고 그 손해를 배상해야 합니다.

제11조 (그 밖의 책임의 한계)

1. 회사는 이용자가 정한 목표나 벌칙의 내용, 적법성, 이행 여부에 관여하지 않으며 이에 대해 책임지지 않습니다.
2. 회사는 이용자가 목표를 수행하는 과정에서 발생한 신체적·정신적·재산적 손해에 대해 책임지지 않습니다. 이용자는 자신의 건강과 안전을 스스로 판단하여 목표를 정해야 합니다.
3. 회사는 이용자가 올린 사진이나 글의 내용에 대해 사전에 검토할 의무를 지지 않습니다. 다만 신고를 받으면 제7조에 따라 조치합니다.
4. 천재지변, 통신 장애, 제3자 서비스의 장애 등 회사의 통제를 벗어난 사유로 인한 서비스 중단에 대해서는 책임지지 않습니다.
5. 서비스는 무료로 제공되며, 회사의 배상 책임은 관계 법령이 허용하는 범위에서 제한됩니다.

다만 회사의 고의 또는 중대한 과실로 인한 손해에 대해서는 위 각 항이 적용되지 않습니다. 또한 소비자에게 보장된 권리를 제한하는 것으로 해석되지 않습니다.

제12조 (준거법과 관할)

이 약관은 대한민국 법을 따릅니다. 서비스 이용과 관련한 분쟁은 의정부지방법원 고양지원을 제1심 관할 법원으로 합니다. 소비자는 자신의 주소지 법원에 소를 제기할 수도 있습니다.

사업자 정보

1. Purpose

These Terms govern your use of GGWP (the "Service"), a mobile application operated by Kommode (the "Company").

2. Definitions

• Match — a challenge between users with an agreed goal, duration, and penalty.
• Proof — a photo or short video, with a note, recording that day's goal.
• Penalty — what a losing user has agreed to do.
• Join code — the string needed to enter a match.

3. Nature of the Service

4. Accounts

1. Accounts are created by signing in with Apple or Google. The Company does not create or store a separate password.
2. Your chosen name and tag are visible to other users in the same match. The email address used to sign in is never shown to other users.
3. If you choose Hide My Email with Sign in with Apple, the Company never receives your real address, only the relay address Apple generates.
4. You must be at least 14 years old (or the minimum age for data consent in your country, if higher) to use the Service.
5. Accounts are personal and may not be transferred or shared.

5. Your Content

1. You retain ownership of the photos, videos, and text you upload.
2. You grant the Company the rights needed to store, reproduce, and display that content in order to operate the Service and show it to others in the same match.
3. Proof photos and videos are visible to participants of the same match only.
4. Submitted proofs cannot be edited by users because they are the basis on which a match is decided. Deletion requests are handled under applicable law and the Privacy Policy; where there is a lawful need to preserve other participants' records, the Company may retain only what is necessary, segregate the record, or de-identify or anonymize it.
5. When a match ends you may create a result card and share it outside the Service. A result card contains the goal, duration, scores, participants' names, and the penalty. It does not contain proof photos or videos. Whether and where to share it is your choice.

6. Prohibited Conduct

• Breaking the law or infringing others' rights
• Creating or joining matches for gambling or to extract money
• Setting goals, penalties, or tags that harass or demean another person
• Posting sexual, violent, or hateful content
• Posting identifiable photos of others without their consent
• Posting content harmful or inappropriate for minors
• Setting or promoting goals or penalties involving self-harm, suicide, dangerous physical activity, excessive alcohol or drug use, extreme food restriction, or other conduct that creates a serious risk to anyone's life, health, or safety
• Interfering with the Service or manipulating match results

7. Reporting and Enforcement

1. You can report objectionable content or users at info@kommode.ai.
2. The Company will review reports and may, within a reasonable period considering applicable law, severity, and urgency, remove content, restrict access, or suspend accounts.
3. You can block a user so that you are not placed in matches with them.
4. If a violation of Section 6 is serious or repeated, or urgent action is reasonably necessary to protect users, third parties, or the Service, the Company may remove content, restrict use, or temporarily or permanently suspend an account without prior notice, subject to any notice required by applicable law.

8. Changes and Interruption

The Company may change or discontinue the Service. Material changes that disadvantage users will be announced in the app or by email at least 30 days before they take effect.

9. Termination

1. You can delete your account at any time from the settings screen.
2. Deleting your account removes your profile and record permanently.
3. Proofs already submitted in matches may be retained for the period stated in the Privacy Policy where necessary to preserve other participants' records or address disputes. After that purpose ends, they will be deleted or rendered non-identifiable.

10. Disputes Between Users

1. A losing user does not perform the penalty, or the parties disagree about whether it was performed
2. A promise to pay money or hand over goods as a penalty is not kept
3. A proof photo is alleged to be staged or misleading
4. Content posted by a user gives rise to defamation, image rights, or similar claims
5. The goal or penalty itself is alleged to be unfair or unlawful

Disputes between users must be resolved between those users, through law enforcement or the courts where appropriate. The Company will cooperate with lawful requests from authorities.

If you breach these Terms or the law and thereby cause harm to a third party, and the Company receives a claim or suffers loss as a result, you will indemnify and hold the Company harmless.

11. Other Limitations of Liability

1. The Company is not involved in and not responsible for the content, legality, or performance of goals and penalties set by users.
2. The Company is not responsible for physical, mental, or financial harm arising from pursuing a goal. You are responsible for judging what is safe for you.
3. The Company has no obligation to pre-screen user content, but acts on reports under Section 7.
4. The Company is not liable for interruptions caused by events outside its reasonable control, including failures of third-party services.
5. The Service is provided free of charge, and the Company's liability is limited to the extent permitted by applicable law.

None of the above applies to loss caused by the Company's intent or gross negligence, and nothing here limits rights guaranteed to consumers under mandatory law.

12. Governing Law

These Terms are governed by the laws of the Republic of Korea. Consumers may also bring proceedings in the courts of their country of residence where local law provides that right.

1. 수집하는 정보

회사는 전화번호, 위치 정보, 연락처 목록, 광고 식별자를 수집하지 않습니다. Apple 로그인에서 「나의 이메일 가리기」를 선택하면 회사는 실제 이메일 주소를 받지 않습니다. 카메라, 마이크, 사진첩은 인증을 올릴 때만 사용합니다. 마이크는 영상으로 인증할 때 소리를 함께 담기 위해서만 쓰며, 사진으로 인증할 때는 쓰지 않습니다. 접근 권한은 기기 설정에서 언제든 철회할 수 있습니다.

2. 처리의 법적 근거 (EU·EEA·영국 이용자)

• 계약의 이행 — 계정 식별자와 이메일 주소, 이름, 태그, 판 정보, 인증 사진과 영상. 이 정보 없이는 서비스를 제공할 수 없습니다. (GDPR 제6조 1항 b호)
• 동의 — 푸시 알림. 언제든 설정에서 철회할 수 있습니다. (제6조 1항 a호)
• 정당한 이익 — 부정 이용과 남용 방지. (제6조 1항 f호)

4. 처리 위탁과 국외 이전

회사는 서비스 운영을 위해 다음 업체에 개인정보 처리를 위탁합니다.

Apple 또는 Google 계정으로 로그인할 때 각 사업자는 로그인 처리 과정에서 자신의 개인정보 처리방침에 따라 독립적으로 개인정보를 처리합니다. 회사는 그 과정에서 계정 식별자와 이메일 주소만 전달받습니다.

회사가 사용하는 Google 서비스의 처리·보관 위치는 각 서비스의 실제 구성과 Google의 데이터 처리 조건에 따릅니다. 개인정보가 EEA·영국 등에서 제3국으로 이전되는 경우 회사는 적용되는 법령에 따라 표준계약조항(SCC) 등 적법한 이전 근거를 적용합니다. 회사는 실제 사용하는 서비스와 데이터 흐름이 이 방침의 내용과 일치하도록 정기적으로 확인합니다.

5. 보유 기간

• 계정 정보(계정 식별자, 이메일 주소, 이름, 태그)는 계정을 삭제할 때까지 보관하며, 삭제 시 지체 없이 파기합니다.
• 인증 사진·영상과 판 기록은 판 운영, 다른 참여자의 기록 보전 및 분쟁 대응을 위해 판 종료 후 1년까지 보관할 수 있습니다. 계정 삭제 요청이 있는 경우에도 위 목적에 필요한 범위에서 해당 기간 동안 분리 보관하거나 식별정보를 제거한 뒤 보관할 수 있으며, 기간이 지나면 삭제하거나 복원이 불가능한 방법으로 익명화합니다. 관계 법령에 따라 더 짧은 기간 내 삭제해야 하는 경우에는 해당 법령을 따릅니다.
• 벌칙이 이행되지 않은 판의 표시는 30일이 지나면 사라집니다.
• 법령에 따라 보관이 요구되는 정보는 해당 기간 동안 보관합니다.

6. 이용자의 권리

이용자는 언제든지 다음 권리를 행사할 수 있습니다.

• 자신의 정보를 열람하고 정정할 권리 — 이름과 태그는 설정 화면에서 직접 바꿀 수 있습니다.
• 계정과 개인정보의 삭제를 요구할 권리 — 설정 화면 또는 이메일을 통해 요청할 수 있습니다. 다만 관계 법령상 보존 의무 또는 다른 참여자의 권리 보호 등 삭제를 제한할 수 있는 적법한 사유가 있는 경우 그 범위와 이유를 안내합니다.
• 처리의 제한이나 이의를 제기할 권리
• 자신의 정보를 옮겨 받을 권리 (데이터 이동권)

권리 행사는 info@kommode.ai로 요청할 수 있습니다. 회사는 요청자의 신원을 합리적인 방법으로 확인한 후 관계 법령이 정한 기간 내에 처리하고, 요청을 전부 또는 일부 받아들이기 어려운 경우 그 사유와 이용 가능한 구제 절차를 안내합니다.

EU·EEA 이용자는 거주 국가의 개인정보 감독기관에, 한국 이용자는 개인정보보호위원회(privacy.go.kr) 또는 개인정보 침해신고센터(privacy.kisa.or.kr, 국번 없이 118)에 신고할 수 있습니다.

7. 아동의 개인정보

서비스는 만 14세 미만을 대상으로 하지 않으며, 만 14세 미만의 정보를 알면서 수집하지 않습니다. 만 14세 미만의 정보가 수집된 사실을 알게 되면 지체 없이 삭제합니다. 거주 국가에서 개인정보 처리 동의 연령이 14세보다 높은 경우 그 연령이 적용됩니다.

8. 안전 조치

• 전송 구간은 암호화(TLS)됩니다.
• 사진·영상과 판 기록은 접근 권한 규칙으로 보호되며, 같은 판에 참여하지 않은 이용자는 접근할 수 없습니다.
• 회사는 서비스 운영에 필요한 최소한의 범위에서만 데이터에 접근합니다.

9. 방침의 변경

이 방침을 변경할 때는 시행일 7일 전(이용자에게 불리한 변경은 30일 전)에 서비스 내 공지 또는 이메일로 알립니다.

10. 문의

1. What We Collect

We do not collect phone numbers, location, contacts, or advertising identifiers. If you use Hide My Email with Sign in with Apple, we never receive your real address. Camera, microphone, and photo library access is used only when you submit a proof. The microphone is used only to record sound with a video proof, never with a photo. All of these can be revoked in your device settings.

• Performance of a contract — account identifier and email address, name, tag, match data, proof photos and videos. Art. 6(1)(b).
• Consent — push notifications, withdrawable at any time. Art. 6(1)(a).
• Legitimate interests — preventing abuse. Art. 6(1)(f).

4. Processors and International Transfers

When you sign in with Apple or Google, each provider processes your data independently under its own privacy policy. We receive only an account identifier and an email address.

The processing and storage locations for Google services depend on the services actually used, their configuration, and Google's applicable data-processing terms. Where personal data is transferred from the EEA, UK, or another jurisdiction to a third country, the Company uses an applicable lawful transfer mechanism, such as Standard Contractual Clauses (SCCs). The Company periodically checks that this Policy reflects the services and data flows actually in use.

5. Retention

• Account data is kept until you delete your account, then erased without undue delay.
• Proof photos, videos, and match records may be retained for up to one year after a match ends for match administration, preservation of other participants' records, and dispute handling. Following an account-deletion request, records needed for those purposes may be segregated or retained after identifiers are removed. At the end of the retention period they are deleted or irreversibly anonymized, unless applicable law requires earlier deletion.
• Unsettled-penalty markers disappear after 30 days.
• Data we are legally required to retain is kept for the required period.

6. Your Rights

• Access and correct your data — name and tag are editable in Settings.
• Request deletion of your account and personal data — through Settings or by email. Where applicable law permits retention for a legal obligation or protection of other participants' rights, we will explain the scope and reason for any limitation.
• Restrict or object to processing.
• Data portability.

Contact info@kommode.ai to exercise these rights. We may reasonably verify your identity and will respond within the period required by applicable law. If we cannot fully grant a request, we will explain the reason and any available remedy. You may also lodge a complaint with your national data protection authority.

7. Children

The Service is not directed to children under 14, and we do not knowingly collect their data. Where your country sets a higher age for data consent, that age applies.

8. Security

• Data is encrypted in transit (TLS).
• Photos, videos, and match records are protected by access rules; users outside a match cannot reach them.
• We access data only as needed to operate the Service.

9. Changes

We announce changes in the app or by email at least 7 days before they take effect, or 30 days for changes that disadvantage users.
